El ’homeschooling’ es muy minoritario en España, pero el movimiento de padres que no quiere escolarizar a sus hijos por la covid preocupa a las autoridades educativas

El movimiento de padres que no quieren llevar a sus hijos a la escuela por miedo a los contagios de coronavirus ha ido creciendo este verano al calor de las redes sociales, donde las adhesiones a manifiestos digitales se cuentan por centenares de miles. ¿Qué fuerza tendrá al final, cuando los colegios abran y los progenitores tengan que enfrentarse a la disyuntiva de desafiar la ley —la normativa española no permite la educación en casa o homeschooling—? Nadie lo sabe. Pero la cuestión preocupa a las autoridades educativas, y así quedó de manifiesto en las reuniones que la semana pasada mantuvieron el Ministerio de Educación y las comunidades autónomas. Su mensaje desde entonces es el mismo: ir a clase es un derecho de los niños, no una decisión que puedan tomar los padres.

La Fiscalía de Menores advirtió el jueves a los progenitores que la escolarización de los menores es obligatoria entre los seis y 16 años. Y que los padres que incumplan la obligación de forma injustificada se enfrentan a consecuencias penales, si bien el ministerio público subrayó este viernes que tendrá en cuenta las circunstancias personales del alumno absentista, así como el estado de salud de los familiares con quienes conviva, a la hora de valorar cada caso. La Abogacía del Estado está elaborando un informe al respecto a petición del Ministerio de Educación. Y la Asociación Española de Pediatría acaba de terminar una guía en la que concluye que el potencial contagio de coronavirus solo supone un riesgo relevante para una pequeña parte de los niños con enfermedades crónicas, mientras que la mayoría de quienes las padecen pueden ir a la escuela.

Antes de que la epidemia infundiera el miedo al contagio en un sector de las familias, agravado por las, en su opinión, insuficientes medidas adoptadas por las Administraciones para hacer de las escuelas lugares seguros, el movimiento que defiende la educación en casa ya existía en España, aunque siempre ha sido muy minoritario. La Asociación por la Libre Educación (ALE), la entidad de referencia del movimiento español, afirma tener unas 400 familias asociadas, las mismas que en 2008, según una información publicada aquel año por este periódico. Su presidenta, Marta Arnau, dice, sin embargo, que en las últimas semanas están recibiendo un aluvión de llamadas y mensajes de personas interesadas en el homeschooling. Y el abogado y profesor de la Universidad Europea de Valencia Jorge Sánchez-Tarazaga, que asesora a la asociación, cuenta que el jueves llegó a tener una videoconferencia con un centenar de personas interesadas en conocer las consecuencias legales que puede acarrearles dejar de llevar a los niños al colegio.

Abundantes problemas

Sus partidarios creen que la educación en casa no ha despegado hasta ahora en España porque no es legal, lo que se traduce en abundantes problemas para padres e hijos. “Hay familias que lo llevan perfectamente. Pero generalmente se sufre, porque si las Administraciones se ponen en contra, las presiones que ejercen hacia la integridad familiar son bastante graves”, señala la presidenta de ALE.

Según el abogado Sánchez-Tarazaga los procesos penales por absentismo escolar (que pueden conllevar hasta seis meses de prisión) no prosperan contra quienes practican la educación en casa, ya que no encajan en el delito de abandono familiar. Pero el letrado admite que los progenitores se exponen a expedientes administrativos de los servicios sociales y a procedimientos civiles que pueden conducir a la pérdida de la tutela e incluso de la patria potestad, ya que las normas estatal y autonómicas identifican la no escolarización con una situación de potencial “riesgo y desamparo del menor”. Y que aunque hay diferencias entre autonomías, lo habitual es que las familias arrojen la toalla y acepten llevar a sus hijos a la escuela o el instituto.

El Tribunal Constitucional zanjó en 2010 el debate jurídico al rechazar el recurso de unos padres de Málaga que no querían escolarizar a sus hijos. De modo que la única manera de que el homeschooling pudiera practicarse con tranquilidad en España pasaría por cambiar la ley, concluye Sánchez-Tarazaga.

Quienes pese a todo lo practican, pasando bajo el radar de los servicios sociales, tienen dificultades para obtener los títulos oficiales, los alumnos suelen perder cursos y está, además, la cuestión del contacto con iguales. “Los niños socializan perfectamente fuera de la escuela, el problema es la ilegalidad. Si hubiera otros sitios donde pudieran socializar por las mañanas, podrían hacerlo de una manera más natural. El problema viene cuando una se tiene que esconder y salir en horario no lectivo. Eso empuja a quedarse en casa quieta, por miedo”, cuenta Vicky, miembro de la Asociación por la Libre Educación, que pide que no se publique su apellido.

Derecho a socializar

¿Por qué algunas familias se exponen pese a todo? “Por respeto a los ritmos de los niños y para darles una educación más personalizada. No estamos en contra que se lleve a los niños a la escuela, pero creemos que esta es otra opción que debería contemplarse, como sucede en otros países”, dice la presidenta de la asociación. El homeschooling tiene mucho arraigo en EE UU y está permitido en países europeos como el Reino Unido y Portugal. Otros, como Alemania, también lo prohíben.

José Saturnino Martínez, profesor de Sociología de la Universidad de La Laguna, nombrado recientemente director de la Agencia de Calidad Universitaria y Evaluación Educativa del Gobierno de Canarias, defiende el veto. “Incluso si estuvieran bien atendidos desde el punto de vista didáctico, el menor tiene el derecho a socializar con otros niños, a aprender a convivir en instituciones más allá de la familia y a entender que no solo somos individuos con deseos, sino que también tenemos responsabilidades con la sociedad”, afirma.
